Terms of Service

1. Who you are agreeing with

These terms are an agreement between you and:

"Momentbound", "we", "us" means Tollånes Development. "You" means the person using the service, whether or not you have an account.

By creating an account or uploading anything, you accept these terms and the Acceptable Use Policy. Account holders accept at signup; guests using an invite link accept on the upload form, before their first upload. Uploading is blocked until they do.

Merely opening an invite link does not bind you to these terms. Browsing an album someone shared with you is not an agreement, and we do not treat it as one.

The Privacy Policy is not something you accept — it explains what we do with personal data and what you can ask us to do about it. We show it to you; there is nothing to agree to.

2. Eligibility

You must be at least 13 to create an account, and guests must be at least 13 to upload. If you are under 13, do not sign up or upload. When you first sign in we ask for your date of birth and keep it write-once. Guests confirm they are 13 or older with a checkbox before their first upload. We rely on your declaration; we do not verify it. Giving a date or confirmation you do not meet is a breach of these terms and we may close the account.

Paid plans may only be bought by an account whose recorded date of birth makes them 18 or over. Under-18 accounts may use the free service. You must be able to enter a binding agreement for any paid purchase, and you must not be barred from using the service under applicable law.

3. Your account

  • Keep your sign-in details secure and do not share your account.
  • Everything done through your account is your responsibility.
  • Tell us promptly at support@momentbound.app if you think your account has been accessed by someone else.
  • Give accurate information, and keep your email address current — we use it for security notices, storage warnings, and deletion warnings.

Sign-in is provided through our authentication provider. If you sign in with a third-party account, that provider's terms also apply to that sign-in.

4. How Momentbound is organised

4.1 Libraries

A library is the container that holds your media. It is the unit we bill and the unit that carries a storage quota. Each account gets one personal library, and you may own additional libraries.

4.2 Roles

Role What they can do
Owner Controls the library: invites and removes members, creates and revokes invite links, manages the plan and quota, and may delete any media in the library
Member Uses the library as permitted by the owner, and uploads media
Contributor Anyone who has uploaded media to a library, whether a member or a guest
Guest Someone using an invite link without an account, limited to what that link permits

4.3 Deletion rights

  • The owner may delete any media in their library, including media uploaded by members or guests.
  • A contributor may delete only media they uploaded themselves.

Understand what this means before you upload to someone else's library: the owner can remove your uploads, and if the owner deletes the library, your uploads go with it. If you want to keep something, keep your own copy.

4.4 Invites are links, and links travel

Invite links work for whoever holds them. If a guest forwards a link, the recipient gets the same access.

  • Invites expire after 30 days by default.
  • Owners can revoke a link, rotate it to a new code, cap the number of uploads, and require approval for uploads.
  • Owners choose how precisely locations appear on shared maps. New albums default to city-level precision.

Sharing decisions are the owner's responsibility. You decide who receives a link and how precise the location data on it is. Where exact locations could put someone at risk, we warn you — but the choice is yours.

5. Your content

5.1 You own it

You keep all rights in the photos, videos, captions, and other content you upload. We claim no ownership.

5.2 The permission we need

To run the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, resize, re-encode, generate previews and thumbnails from, extract metadata from, and display your content — solely in order to provide Momentbound to you and to the people you share with.

This licence exists only to operate the service. It ends when you delete the content or your account, except for copies still ageing out of backups.

We will not use your content to advertise, sell it, license it to third parties, train AI models on it, or publish it outside the sharing you set up.

5.3 You must have the right to upload it

You confirm that you have the rights and permissions needed for everything you upload, including permission from identifiable people where required. Do not upload content you have no right to share.

5.4 Content in shared libraries

When you upload to a library you do not own, you are giving the owner and everyone they have invited access to that content, on the terms in section 4.

6. Acceptable use

The Acceptable Use Policy is part of these terms. In short: no illegal content, no content that harms or endangers people, no infringement, no abuse of the service or other users' accounts, and no circumventing quotas or access controls.

7. Storage, plans, and limits

7.1 Plans

Current prices are shown in the app and on our website before you buy.

Quota is measured per library, and covers the stored media in that library including the versions we generate.

7.2 Free-tier media behaviour

On the free tier we process your upload, keep the display-optimised version, and remove the original after a short window. This is not a backup service, and on the free tier the original file you uploaded will not be available for download later. Keep your own copies.

7.3 Upload limits

We support the photo and video formats that normal phones and cameras produce, and typical exports from them. We do not support camera RAW files or professional video codecs. Specific format, file-size, and duration limits are published separately and may change.

7.4 Over quota

If a library exceeds its quota, uploads to it stop until you free space or upgrade. Existing media stays accessible. Where we offer metered overage, it is disclosed before you incur it.

7.5 Downgrades and cancellation

If you cancel or downgrade a paid library:

  • When the paid period actually ends, that library moves to the free Space saver setting (or unpaid + Space saver for an extra library). If it was not already on Space saver, we lower quality and restart the original-file grace clock: 30 days for photos, 7 days for video, from that moment.
  • Changing quality while you are still on a paid plan does not restart that clock. The cancellation flow shows you this at the time.
  • After the grace period, originals are removed and the display-optimised versions remain.
  • If you move back to Original quality while originals are still within their grace window, we keep them. Originals already removed are not restored.
  • If the library is over the lower plan's quota, uploads stop until you free space.
  • We do not delete your media simply because you stopped paying — but we stop keeping originals, as described.

7.6 Rate limits

We apply rate limits to protect the service. Automated bulk use that degrades the service for others is not permitted.

8. Subscriptions and payment

Detailed billing terms will be published as separate Subscription and Billing Terms before paid plans launch. Until then:

  • Subscriptions renew automatically until cancelled.
  • Cancel through the same channel you bought from — our payment provider's portal, or the App Store or Google Play if you subscribed there.
  • Cancelling stops future charges; it does not refund the current period unless the law requires otherwise or we agree.
  • Prices may change. We will give notice before a change affects you.
  • Where a store handles your purchase, that store's refund rules also apply.

Consumer rights

If you are a consumer in the EEA, you have statutory rights including a right of withdrawal for distance contracts. Nothing in these terms removes them. Because digital services begin immediately, you may be asked to acknowledge that performance starts right away — which can affect the withdrawal right for the portion already delivered.

9. Deleting your account

You can delete your account in the app, or from our website at momentbound.app/delete-account. We ask you to confirm your identity first.

If you own a library with other members, we will not delete your account until you transfer that library to one of them — deleting it would destroy their photos. Transferring moves the library and its media to the new owner, who then chooses their own plan; it does not transfer your payment method.

Once nothing is blocking it, any subscription on a library you own is cancelled automatically as the first step, and if that cancellation fails we delete nothing. You will not keep being billed for an account you deleted.

Libraries you own are then deleted, including other people's uploads to them.

Section 8 of the Privacy Policy explains what is retained afterwards and why.

10. Inactive free libraries

We may delete a free library after 24 months of inactivity. We will send warnings to the account email in advance. Keep your email address current.

11. Reporting problems

  • Abuse, illegal content, or safety concerns: use the Report action on the photo, album, journey section, or comment, or email abuse@momentbound.app. Guests can report without creating an account.
  • Copyright: email abuse@momentbound.app with the URL or identifier, what the work is, your rights in it, your contact details, and a good-faith statement.
  • Security vulnerabilities: security@momentbound.app.

We record reports, assess them, and may restrict access to or remove content, suspend accounts, preserve evidence, or report matters to authorities where legally required. Where appropriate we tell the uploader and let them respond.

12. Suspension and termination

We may suspend or terminate your access if you break these terms or the Acceptable Use Policy, if we are legally required to, or if your use threatens the security, integrity, or cost of the service.

Where possible we will tell you why and give you a chance to fix it. For serious matters — illegal content, or risk to someone's safety — we may act immediately.

You can stop using Momentbound at any time by deleting your account.

13. Changes to the service

Momentbound is under active development. We may add, change, or remove features. Where a change would materially reduce something you rely on, or remove access to content, we will give reasonable notice and, where practical, a way to export your media first.

14. Beta

While Momentbound is in beta:

  • It may be unreliable, and features may change or disappear.
  • We intend to keep your uploads and migrate them as the product changes, but we cannot guarantee it.
  • Keep your own copies of anything irreplaceable.

15. Availability

We aim to keep Momentbound available, but we do not promise uninterrupted service. We may take it down for maintenance. We depend on third-party hosting, storage, authentication, and delivery providers whose outages affect us.

Momentbound is not a backup service. It is a place to organise and share memories. Keep independent copies of anything you cannot lose.

16. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim.

We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded under Norwegian or applicable EEA consumer law. If you are a consumer, your statutory rights are unaffected by this section.

17. Disputes and governing law

These terms are governed by Norwegian law. Disputes may be brought before the Norwegian courts.

If you are a consumer resident elsewhere in the EEA, you keep the protection of your local mandatory consumer law and may be able to bring proceedings in your country of residence. Norwegian consumers may also contact Forbrukerrådet / Forbrukerklageutvalget.

18. Other terms

  • Whole agreement: these terms, the Privacy Policy, and the Acceptable Use Policy are the agreement between us.
  • Severability: if part is unenforceable, the rest stands.
  • No waiver: not enforcing a term does not waive it.
  • Assignment: you may not transfer your rights under these terms. We may transfer ours if the business is transferred, and will tell you.
  • Language: the English version is authoritative unless we publish a translation stated to prevail.

19. Changes to these terms

We will post new versions here with a new effective date. For material changes we will notify you by email or in the app in advance, and where the change is significant we may ask you to accept the new version. If you do not accept, you can stop using the service and delete your account.
